AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Where a product has a major failure, you may be entitled to a replacement, refund or compensation in accordance with the Australian Consumer Law.
QUOTE VALIDITY
This quote is valid for 14 days from the date of issue. After 14 days, pricing must be reconfirmed with Zen Building Group before an order can be placed. Prices are subject to change without notice after the validity period expires.
PRICE ADJUSTMENTS
Quoted prices are based on the specifications provided at the time of quoting. Prices may be revised if:
- Dimensions change by more than 50mm in any direction (height, width, or depth)
- Specifications, colour, finish, or hardware selections are altered during the shop drawing process
- Material or supply costs change between the quote date and order confirmation
If a price change is required, Zen Building Group will notify you promptly. Written approval of the revised price is required before manufacturing proceeds.
PAYMENT TERMS
Doors & Windows
- A deposit is required to confirm your order and initiate the shop drawing, consultation, and production process.
- Deposit invoices are valid for 7 days from issue. If payment is not received within 7 days, we may cancel the invoice and the order will not proceed unless reconfirmed in writing.
- The balance is due strictly prior to shipment from our overseas factory.
- Once production is complete, our accounts team will contact you with completion images and your outstanding balance.
- You will have 5 business days from the date of the balance invoice to make payment.
LATE PAYMENT
All products supplied by Zen Building Group are custom-made and manufactured to order overseas. Late payment directly impacts our storage, freight holding, and financing costs.
If the balance invoice is not paid within 5 business days of the invoice date, the following charges apply automatically:
Late Payment Interest
- 10% per annum, accruing daily from the first business day after the due date.
Administration Fee
- $200 (ex. GST) per overdue notice issued after the payment due date.
Storage Fees
- $50 + GST per crate, per week, or any higher third-party warehouse holding fees actually incurred by Zen Building Group, whichever is greater. Storage fees accrue until full payment is received and must be paid in full before delivery can be arranged.
These charges reflect Zen Building Group’s genuine costs arising from deferred payment on custom-imported products, including financing, freight holding, and administrative resources. Late payment terms are agreed to by placing an order and accepting these
CANCELLATIONS & REFUNDS
Doors & Windows
If you cancel within 7 days of paying your deposit, an administration charge of $1,500 + GST or 5% of the total order value (whichever is greater) will be deducted from your refund. Credit card fees are non-refundable.
Cancellations after 7 days are not accepted for change of mind. All orders are final once the cooling-off period has passed, shop drawings have been approved or production has commenced. No deposit refund will be issued, except where required under the Australian Consumer Law.
PRODUCTION & SHIPPING DELAYS
Lead times are estimates only. Zen Building Group is not financially liable for delays arising from production, overseas manufacturing,
shipping, freight, customs, port congestion, delivery scheduling, supply chain disruption, war, government action, force majeure events or any other factor beyond our reasonable control.
Zen Building Group is not liable for any consequential project or site delays, including builder programming, trade sequencing, construction scheduling, handover delays, property sale or settlement impacts, liquidated damages, loss of rent, loss of profit or delay costs. Nothing in this clause limits any rights available under the Australian Consumer Law.
Orders not placed into production within 3 months of the invoice or order date may be subject to price increases.
MEASUREMENTS & OPENINGS
Zen Building Group is not responsible for the accuracy of site measurements provided by the customer, builder, or third party. You must confirm correct opening dimensions with a qualified builder, installer, or carpenter before proceeding.
Where a Zen-recommended installer conducts the site measure, they are responsible for the measurements taken. In new builds or renovations, the builder is responsible for ensuring openings align with the specifications agreed in the shop drawings.
SHOP DRAWINGS & SIGN-OFF
A detailed CAD shop drawing will be produced based on your order specifications. Manufacturing will not commence until you or your builder/installer has signed off the shop drawings.
Once signed off, Zen Building Group will manufacture strictly to those drawings. We accept no liability for errors, incorrect dimensions, or specification changes that were present in the signed drawings. Ensure your installer reviews all drawings in detail before approving.
INSTALLATION
Zen Building Group does not install products. Installation must be carried out by a qualified carpenter or licensed installer.
We are not liable for:
- Incorrect installation by any party
- Changes to door or window openings after shop drawing sign-off
- Damage caused during or after installation by third parties
If you are referred to one of our recommended installers, their engagement is directly between you (or your builder) and them. Zen Building Group has no liability for their work, callout fees, or any additional charges.
WARRANTY
- Zen Building Group provides the following manufacturer’s warranties on all doors and windows, backed by our overseas factory. Where a manufacturing defect is confirmed, Zen Building Group will repair or replace the affected product or part at no charge within a reasonable timeframe. Incorrect installation voids all warranty coverage.
- Glass Warranty (6 Years): Covers manufacturing defects for 6 years from the date of delivery. Excludes cracking/shattering, impact or thermal stress, site damage, notched glass smaller than 2 sqm, glass with multiple curves or complex angles, incorrect handling, storage or installation, building movement, and damage by trades or others after delivery.
- Paint / Coating Warranty (10 Years): Covers manufacturing defects for 10 years from the date of delivery. Excludes non- standard profiles or configurations, damage from drilling, cutting, scratching, improper cleaning, installation within 1km of the coast or direct/pooling water contact without the Zen Marine Grade Paint upgrade, site conditions, and damage by trades or others after delivery.
If rectification is required and Zen Building Group must send a subcontractor to site due to incorrect installation by others, the cost of that visit will be charged to the customer.
PRODUCT TOLERANCES & IMPERFECTIONS
All Zen products are custom-made by hand. As handcrafted items, they may exhibit cosmetic imperfections including:
- Variations in steel, iron, welding, or paint finish
- Minor bowing in steel or iron frames due to material weight, length, or transit
These characteristics are within the accepted tolerance for handmade custom products and do not constitute defects. Any issue outside reasonable manufacturing tolerance will be assessed by Zen Building Group acting reasonably and rectified under the applicable warranty and Australian Consumer Law.
Painted Finish Inspection
Painted surfaces should be assessed from a minimum viewing distance of 1 metre, under normal diffuse daylight or non-critical, shadow- free lighting. Inspection should not be carried out using glancing light or extreme lighting angles, as these can artificially highlight minor texture, surface or fabrication variations.
Minor scuffs, inclusions, colour or texture variations, or surface marks that are only visible from closer than 1 metre are generally not considered grounds for rejection, provided the finish presents a reasonably uniform colour and texture from normal viewing distance and is free from blisters, excessive roughness, or scratches that penetrate through to the base metal.
For larger external architectural applications, the relevant viewing distance may be greater than 1 metre to reflect normal in-situ viewing conditions. These inspection principles are consistent with accepted powder coating assessment guidance, including AS 3715 where applicable.
DELIVERY
Once your order is ready, we will contact you to arrange delivery. Please note:
- You must be present at the delivery address during the allocated time slot, or provide authority to leave (ATL).
- Failure to accept delivery without ATL will incur additional redelivery charges.
- Zen Building Group does not provide storage. Holding fees charged by our freight warehouse will be passed on and must be paid before delivery.
- Crates are placed at the front of the site only. Drivers cannot access garages, narrow laneways, or rear/side access points.
IMPORTANT — Delivery Inspection
Inspect all products carefully upon delivery while still in original packaging. Any visible transit damage must be photographed in the original crate/packaging before unpacking or installation.
Transit damage claims may be rejected where goods have been removed from packaging, stored incorrectly, handled by others or installed before notification. This does not limit any rights available under the Australian Consumer Law for manufacturing defects. Crates must remain covered and dry at all times to maintain warranty eligibility.
TRANSIT DAMAGE
Zen Building Group bears the risk of loss or damage during international and domestic transit until delivery to site. If goods arrive damaged, Zen Building Group will repair or replace the affected goods within a reasonable timeframe at no cost to the customer, provided the damage is reported promptly and photographed while the goods remain in their original packaging.
EXTENDED STORAGE
Extended storage of products in the original wooden crate (with foam, plastic wrap, or adhesive on glass) is not recommended. Prolonged storage in these conditions may cause damage and will void warranty coverage for affected items.
INJURY & LIABILITY
Zen Building Group is not responsible or liable for personal injury, property damage, or financial loss caused by:
- Incorrect installation of any product
- Failure to follow installation guidelines or safety requirements
- Improper use of any product after delivery
To the maximum extent permitted by law, and subject to any rights available under the Australian Consumer Law, Zen Building Group’s liability is limited to the repair, replacement or refund of the goods supplied under the relevant order. Zen Building Group is not liable for indirect, consequential or project-related loss, including delay costs, loss of profit, loss of opportunity, builder costs, trade delay costs, property settlement impacts or handover delays.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
